Massachusetts PFML Plan Details


Paid family and medical leave (PFML) is a program designed to help people in Massachusetts take paid time off of work for family or medical reasons. 


Massachusetts’s PFML law is funded through employer and employee contributions, and is different from the federal Family and Medical Leave Act, and from any benefits an employer might already offer. 


What qualifying events could a worker use leave for?

  • Caring for their own serious health condition as certified by a health care provider, including illness, injury, or pregnancy/childbirth (up to 20 weeks of paid medical leave)
  • Caring for a family member with a serious health condition as certified by a health care provider, including illness, injury, or pregnancy/childbirth (up to 12 weeks of paid family leave)
  • Bonding with their child during the first 12 months after birth, adoption, or placement (up to 12 weeks of paid family leave)
  • Caring for a family member who was injured serving in the armed forces (up to 26 weeks of paid family leave)
  • Managing affairs while a family member is on active duty (up to 12 weeks of paid family leave)

Private Plan Details 


Employers applying for an exemption with a purchased private plan should obtain a paid leave private plan from an insurance carrier licensed by the Division of Insurance (DOI).  Once the plan has

been purchased, you will need the policy form number approved by the DOI. This number can usually be found on your paid leave policy in the bottom left corner of the first page. You must then work with your insurance carrier to complete the Massachusetts Paid Family and Medical Leave Confirmation of Insurance form.   


The Confirmation of Insurance form must be signed by both a representative of the employer and a representative of the insurance carrier (electronic signatures are acceptable) and list the insurance carrier’s approved DOI policy form number.

DOI has a list of  Paid Family Medical Leave Products that are approved to provide paid family and medical leave policies that meet  DFML standards. This list is updated regularly.
